GENERAL

These are the general terms and conditions under which KALINA (“I”, “me”) supplies vintage items and items made by KALINA (“items”) and interior design consultancy services (“services”) to my clients (“you”). Please read these terms and conditions carefully as they contain important information relating to this website and how KALINA operates. I reserve the right to change these terms and conditions from time to time so please look through these regularly and before placing an order. By placing an order for any item or service from KALINA you agree to be bound by these terms and conditions.

OWNERSHIP + RIGHTS

This site is owned and operated by Kim Kalinowski, KALINA, 51 Kingsley Road, Brighton, East Sussex, BN1 5NH. All rights, including copyright, in this website are owned by or licensed to KALINA. You may not modify, distribute or repost anything on this website for any purpose. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without my permission.

PRICING, ORDERING + PAYMENTS

The prices payable for items are as set out on the website, listed in British Pounds Sterling and payment can only be accepted in British Pounds Sterling. At the time of publication all prices are correct; items are charged at the price shown on the website at the time an order is placed. All prices are displayed excluding VAT. If unable to supply the items you have ordered at the price or conditions shown, I will notify you as soon as possible. All orders are subject to acceptance and availability. All items and shipping costs (where incurred) must be paid for in full before being dispatched. Payments for services are agreed at time of face-to-face or remote brief presentation(s) and invoiced according to our agreement, usually paid in advance.

LIABILITY

Items are owned by KALINA until all money has exchanged hands and the items have left the premises. While all lighting and other electrical items are professionally rewired and PAT tested (unless otherwise stated), I recommend that you ensure that all electrical items are inspected, tested, certified and fitted by a qualified electrician.  KALINA is not liable for any loss, injury or death caused by electrical items that have not been inspected, tested, certified and fitted by a qualified electrician. Upholstered items that do not meet current fire regulations must be appreciated as a work of art from a safe distance. KALINA’s liability for losses is strictly limited to the amount paid by you for a product or service. KALINA will not be liable for any loss, damage or expense or personal injury arising out of or in connection with the supply of items or services offered through this website including but not limited to indirect or consequential loss or damage, loss of data, income, profit or opportunity, loss or damage to property, personal injury and claims by third parties, even if KALINA has been advised of the possibility of such loss or damage and/or such loss or damage were reasonably foreseeable. KALINA is only responsible for losses that are a natural, foreseeable consequence of my breach of these terms and conditions. I do not accept liability if prevented or delayed from complying with my obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) do or fail to do, or is due to events which are beyond my reasonable control. Furthermore, I do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption. You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase items from our site. The importation or exportation of certain items to you may be prohibited by certain national laws. I make no representation and accept no liability in respect of the export or import of the items you purchase from me.

CANCELLATION

KALINA reserves the right not to process and complete your order if:

• The item has sold on another selling platform or there is insufficient stock to deliver the item you have ordered;

• We do not deliver to your area; or

• One or more of the items you ordered was listed at an incorrect price due to a typographical error.

If I do not process your order for the above reasons, I will notify you by email and credit to your account any sum deducted by me from your credit/debit card as soon as possible, and within 14 days.

Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134, with the exception of MADE BY KALINA items and sale items, you have the legal right to cancel your order up to 14 calendar days after the day on which you receive your items. Should you wish to cancel your order please notify me by email as soon as possible. You cannot cancel your contract if the items you have ordered are bespoke; for example all MADE BY KALINA pieces. If you have received the items before you cancel your contract then you must send the items back to my contact address at your own cost and risk. If you cancel your contract but I have already processed the items for delivery, you should not unpack the items when they are received by you and you must send the items back to me at my contact address at your own cost and risk as soon as possible. Once you have notified me that you are cancelling your contract, and I have received the items back, I will refund any sum debited from your credit or debit card within 14 calendar days excluding delivery charges. I reserve the right to make a deduction from your refund for any loss in the value of the items supplied if the loss is the result of unnecessary handling by you, for example using the items prior to cancellation.

PRIVACY

You acknowledge and agree to be bound by the terms of my PRIVACY POLICY.

AGREEMENT
The terms and conditions listed above form the entire agreement between KALINA and you, the client. I shall not be in breach of these terms and conditions if any delay or failure is due to circumstances beyond my control, such as fire, industrial action, the breakdown of systems or network disruption, flood, accident, fire or explosion.
